WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
In consideration of being allowed to participate in Masters swimming at Pinehurst Cabana Club (hereinafter referred to as "PCC"), I, the undersigned participant acknowledge and agree to the following terms:
Assumption of Risk*
I understand that swimming and related activities involve inherent risks, including but not limited to drowning, slips, falls, collisions, bodily injuries, and exposure to waterborne illnesses. I voluntarily assume all risks associated with my participation.
I acknowledge that no lifeguard is on duty during Masters swim.
Release of Liability*
I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and hold harmless PCC, its owners, directors, officers, coaches, employees, volunteers, and representatives from any and all liability, claims, demands, actions, or causes of action related to any injury, illness, disability, death, or property damage arising out of or in connection with my participation in any Masters activities at PCC, whether caused by negligence or otherwise.

I agree to the Release of Liability.
Indemnification*
I agree to indemnify and hold harmless PCC from any claims, damages, costs, or expenses (including attorney’s fees) arising from my participation in PCC Masters swimming.
Pinehurst Cabana Club will not be held responsible while I participate in Masters Swim.
Medical Authorization*
I authorize PCC staff and Board of Directors to obtain emergency medical treatment for me if necessary. I understand that I am responsible for any medical expenses incurred as a result of participation.
I affirm that my general health is good, and I am not adversely affected by the exercise that I will currently undertake. I further affirm that I am able to perform exercise of a moderate nature. I am not currently under the care of a physician, who should be advised of my desire to participate in this physical activity. If I am under the care of a physician, I affirmatively state that I have received his/her permission to participate in moderate exercise in PCC Masters.
I am able to participate in moderate exercise and authorize PCC Staff and/or Board of Directors to obtain necessary medical treatment.
Compliance with Rules*
- I agree that I am at least 18 years of age and acknowledge that no person under the age of 18 is allowed to swim with me during Masters.
- I agree to always having a second person with me when I swim Masters.
- I acknowledge that only PCC members and their guests are allowed to swim Masters.
- I agree to follow all PPC rules and safety guidelines. Failure to comply may result in removal from the PCC Masters program.
